WEDDING VIDEOGRAPHY AGREEMENT

 

Below is my contract for you to read over and sign. It sets out all the important information on how we will work together, what you can expect time-wise, payment terms and some other important logistical details.

The contract is designed to protect both of us from any misunderstandings. Think of it as much as your document as mine. If there is anything you are unclear about, do not hesitate to fire over your questions. It is super important that you feel happy and confident before you sign the dotted line (or tick the box in this digital world!), so take your time and let us know if anything is unclear.

 
 

 
VIDEOGRAPHERS’S RESPONSIBILITIES
Ebony Vukelic ("Videographer") hereby agrees to perform videography services for the Client at the Event specified above in a professional, workmanlike manner according to the prevailing standards in the industry ("Services"). Videographer may employ one or more assistants. The Videographer is not responsible for the impact on the final product of any interference caused by guests or other vendors at the Event. Videographer will make every effort to obtain, but cannot guarantee delivery of, any specific footage requested by client because of Videographer’s lack of control over the Event, its participants, weather, and any rules or restrictions of the venue or official conducting the Event.

If Videographer is exposed to (i) unsafe conditions, or (ii) objectionable or illegal acts at the Event, Videographer reserves the right to take reasonable action to remedy such a situation, including but not limited to leaving the Event. In such an event, Videographer shall not be obligated to refund any of the fees paid by the Client because of such action.


ENTIRE AGREEMENT
This agreement contains the entire understanding between the Videographer and the Client as to the Videography services outlined in this Agreement. All previous negotiations, understandings, warranties, or commitments concerning the videography services are merged in and superseded by this Agreement and are of no effect. 

RESERVATION
Upon the Clients signature, the Videographer will reserve the time and date of the event, and will not make other reservations for that time and date. For this reason, the Reservation 50% Deposit is non-refundable, even if the date is changed or the event is cancelled for any reason; including but not limited to, acts of God, fire and/or extreme weather. The Reservation Deposit is to be paid at the time of signing the contract. The Reservation Deposit is applied towards the contracted and quoted cost.

CANCELLATION
In the event that the Client cancels the videography services outlined in this Agreement before the event takes place, the reservation deposit will be forfeited. The Videographer agrees to refund all additional paid money (less expenditures for which receipts will be provided), to the Client.

COVID-19 POLICY
In the event of rescheduling or cancelling due to COVID-19 lockdowns or restrictions, rescheduled wedding dates must be booked again within 18 months of the original wedding date and dates are subject to the Photographer’s availability.

The Client will not incur any rescheduling fees, price increases or loss of payments already made should both parties be able to mutually agree on a new date.


EXPENSES INCURRED
All reasonable travel and accommodation expenses incurred by the Videographer in connection with the videography services outlined in this Agreement are inclusive of the total package cost.

LIMIT OF LIABILITY
If the Videographer cannot perform this Agreement due to personal injury, illness, or any other cause beyond the control of the Videographer, all monies paid shall be returned to the Client. The Videographer has working methods in place to prevent loss or damage to the Client’s footage and audio recordings but cannot and does not, guarantee that recordings of the event will not be lost, stolen, or destroyed for reasons within or beyond the Videographer’s control. The Client agrees that the Videographer’s full and complete responsibility and liability is limited to the return of all payments received for the event.

EVENT SCHEDULE
The Client agrees to confirm the schedule no later than one-week prior to the event. Notification of any changes in schedule or location must be made in a timely manner and confirmation of receipt must be obtained from the Videographer by the Client.

EVENT GUIDE
The Client will be responsible for (or have someone designated for this responsibility) identifying people/ objects of whom/ which specific footage is desired. The Videographer will not be held accountable for not capturing desired people if there is no one to assist in identifying or gathering people for the footage.

EVENT MEAL
The Videographer and second shooter (if present) will be provided with a guest meal.

MODEL RELEASE
The Client hereby grants to the Videographer the irrevocable and unrestricted right to use and publish footage of the Client or in which the Client may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction. The Client hereby releases the Videographer and assigns from any and all claims and liability relating to said footage. The Client agrees that the Client’s guests, spouse, family members, and attendees of the event will be made aware of the filming taking place at this event and that they may at any time be recorded. It is the Client’s responsibility to inform attendees of this.

FOOTAGE
Delivery of raw footage is not included, only final edits. The Videographer retains the right to edit the footage and omit any clips and audio. It is understood that the Videographer will not deliver every clip taken. The Client agrees to abide by the Videographer’s editing decisions.

Final videos produced by the Videographer are protected by Australian Copyright Law (all rights reserved). Upon final payment by the Client, the Client is allowed to display the resulting video/s for personal use. Said video/s may not be altered or reproduced in any manner without prior written permission of the Videographer. The Client gives the Videographer the unrestricted right to the use of all footage and audio, plus stills captured for the purposes of the Videographer’s marketing and promotion. This includes but is not limited to social media platforms, print advertising, website content, and promotional documents.

RESTRICTIONS, ENVIRONMENT, AND FILMING
Restrictions imposed by others (church, photographer, guests, reception, etc) and the constraints of the physical environment, safety, weather, poor acoustic conditions or other conditions outside our control can affect the quality and extent of the video coverage possible and the Videographer will not be responsible for scenes not included.

Although every possible care will be taken to capture videography of all important and special events during the wedding, the Videographer cannot place an unconditional guarantee on the above as a sole videographer, which the Client acknowledges will create limitations to the final product. The Videographer cannot guarantee video quality in adverse lighting or weather conditions, or in rooms generating a strong colour tinge to the light which may not be satisfactorily correctable during editing. It should be noted that filming in low-light situations (e.g. small rooms, candlelight, disco/dance areas, evenings and nights outdoors) may impact the quality of the image captured by the camera. The client should acknowledge that videography requires reasonable lighting and that production may be compromised due to low or poor light levels. Environmental audio is recorded during certain parts of the day such as the ceremony and speeches. The Videographer will take great care that audio is recorded as professionally as possible but is not responsible for extraneous sounds such as, but not limited to, air conditioning units, the ringing of mobile phones, passing emergency vehicles, crying children, coughing etc.

MUSIC LICENSING
All music used within the final video/s will obtain licensing, so as to not breach any copyright laws. This does mean that there are limitations and the Videographer may not always be able to use the Client’s requested track/s. Any music suggestions that the Client may give the Videographer during the booking questionnaire or post-wedding day, are not guaranteed to be included.

Any final editing decisions are of the sole discretion of the Videographer.

DELIVERY OF PROJECT
The Videographer will use all reasonable skill and effort to create the project and to deliver the completed project within 4 months of the wedding date. Failure to deliver by this date is not a breach of this agreement. The Client acknowledges and agrees that any delay in the completion of the project due to actions or negligence of the Client, transportation delays, illness, or circumstances outside the control of The Videographer shall alter the delivery date. The Videographer will make a reasonable effort to notify the Client of any delays to the estimated delivery date as soon as possible.

SEVERABILITY
If any provision of this Agreement is held to be invalid or unenforceable under the law, the validity of this agreement as a whole shall not be affected, and all other provisions of the agreement shall remain in full force and effect.

PAYMENT
The Client agrees to pay the Videographer in accordance with the following payment schedule:

a) Upon signing the Agreement, the Client shall pay a non-refundable reservation deposit of 50% of the total package to the Videographer;
b) Upon the handover of the final video/s from the Videographer to the Client, the Client shall pay the remaining 50% balance to the Videographer.
