WEDDING PHOTOGRAPHER AGREEMENT

 

Below is my contract for you to read over and sign. It sets out all the important information on how we will work together, what you can expect time-wise, payment terms and some other important logistical details.

The contract is designed to protect both of us from any misunderstandings. Think of it as much as your document as mine. If there is anything you are unclear about, do not hesitate to fire over your questions. It is super important that you feel happy and confident before you sign the dotted line (or tick the box in this digital world!), so take your time and let us know if anything is unclear.

PHOTOGRAPHER’S RESPONSIBILITIES
Tessa Eckersley ("Photographer") hereby agrees to perform photographic services for Client at the Event specified above in a professional, workmanlike manner according to the prevailing standards in the industry ("Services"). Photographer may employ one or more assistants. The photographer is not responsible for the impact on the final product of any interference caused by guests or other vendors at the Event. Photographer will make every effort to obtain, but cannot guarantee delivery of, any specific images requested by client because of Photographer’s lack of control over the Event, its participants, weather, and any rules or restrictions of the venue or official conducting the Event.

If Photographer is exposed to (i) unsafe conditions, or (ii) objectionable or illegal acts at the Event, Photographer reserves the right to take reasonable action to remedy such a situation, including but not limited to leaving the Event. In such an event, Photographer shall not be obligated to refund any of the fees paid by Client because of such action.


ENTIRE AGREEMENT
This agreement contains the entire understanding between the Photographer and the Client as to the photography services outlined in this Agreement. All previous negotiations, understandings, warranties, or commitments concerning the photography services are merged in and superseded by this Agreement and are of no effect. 

SECOND SHOOTER
The Photographer may engage a second shooter for the event. In such circumstances, the costs of the second shooter will be inclusive of the total package cost.

RESERVATION
Upon the Clients signature, the Photographer will reserve the time and date of the event, and will not make other reservations for that time and date. For this reason, the Reservation 20% Deposit is non-refundable, even if the date is changed or the event is cancelled for any reason; including but not limited to, acts of God, fire and/or extreme weather. The Reservation Deposit is to be paid at the time of signing the contract. The Reservation Deposit is applied towards the contracted wedding photography package.

CANCELLATION
In the event that the Client cancels the photography services outlined in this Agreement before the event takes place, the reservation deposit will be forfeit. The Photographer agrees to refund all additional paid money (less expenditures for which receipts will be provided), to the Client.

COVID-19 POLICY
In the event of rescheduling or cancelling due to COVID-19 lockdowns or restrictions, rescheduled wedding dates must be booked again within 18 months of the original wedding date and dates are subject to the Photographer’s availability.

The Client will not incur any rescheduling fees, price increases or loss of payments already made should both parties be able to mutually agree on a new date.


EXPENSES INCURRED
All reasonable travel and accommodation expenses incurred by the Photographer in connection with the photography services outlined in this Agreement are inclusive of the total package cost.

LIMIT OF LIABILITY
If the Photographer cannot perform this Agreement due to personal injury, illness, or any other cause beyond the control of the Photographer, all monies paid shall be returned to the Client. The Photographer has working methods in place to prevent loss or damage to the Client’s images but cannot and does not, guarantee that photographs/images of the event will not be lost, stolen, or destroyed for reasons within or beyond the Photographer’s control. The Client agrees that the Photographer’s full and complete responsibility and liability is limited to the return of all payments received for the event.

EVENT SCHEDULE
The Client agrees to confirm the schedule no later than one-week prior to the event. Notification of any changes in schedule or location must be made in a timely manner and confirmation of receipt must be obtained from the Photographer by the Client.

EVENT GUIDE
The Client will be responsible for (or have someone designated for this responsibility) identifying people/ objects of whom/ which specific photographs are desired. The Photographer will not be held accountable for not photographing desired people if there is no one to assist in identifying or gathering people for the photograph(s).

EVENT MEAL
The Photographer and second shooter (if present) will be provided with a guest meal.

MODEL RELEASE
The Client hereby grants to the Photographer the irrevocable and unrestricted right to use and publish photographs of the Client or in which the Client may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction. The Client hereby releases the Photographer and assigns from any and all claims and liability relating to said photographs. The Client agrees that the client’s guests, spouse, family members, and attendees of the event will be made aware of the photography taking place at this event and that they may at any time become subjects of the photographs. It is the Client’s responsibility to inform attendees of this.

IMAGES
Original photographs are not included in the Wedding Photography Package, only edits. The Photographer retains the right to edit the photographs and omit any image. It is understood that the Photographer will not deliver every exposure taken. The Client agrees to abide by the Photographer’s editing decisions.

Images produced by the Photographer are protected by Australian Copyright Law (all rights reserved). Upon final payment by the Client, the Client is allowed to display resulting images for personal use. Said images may not be altered or reproduced in any manner without prior written permission of the Photographer. The Client will receive a high-resolution USB with printing rights.

The Client gives the Photographer the right to the use of all images captured for the purposes of the photographers marketing and promotion on social media platforms only. The Photographer agrees to forgo the right to use images on all other platforms, this includes but not limited to print advertising, website content and promotional documents.

SEVERABILITY
If any provision of this Agreement is held to be invalid or unenforceable under the law, the validity of this agreement as a whole shall not be affected, and all other provisions of the agreement shall remain in full force and effect.

PAYMENT
The Client agrees to pay the Photographer in accordance with the following payment schedule:

a) Upon signing the Agreement, the Client shall pay a non-refundable reservation deposit of. 20% of the total package to the Photographer;
b) No later than 60 days prior to the event, the Client shall pay a second deposit of 50% of the remaining sum of the total package to the Photographer;
c) Prior to the handover of the images from the Photographer to the Client, the Client shall pay the remaining balance of the total package the Photographer.

DELIVERY OF FINAL IMAGES
All photos are to be edited and delivered within 3 months with a sneak peek preview provided within 7 days of the event.
